When a home is purchased at Lions Gate Community an agreement is signed by each homeowner stating that they will abide by the terms in the Declaration and Bylaws.  The following Rules and Regulations, and Architectural Controls are designed for your protection, safety, and enhancement of your property value.  It is the responsibility of the Board of Directors to enforce these Rules and Regulations.

FUNCTION OF THE ARCHITECTURAL STANDARDS COMMITTEE:

The Board of Directors appoints this Committee. It must consist of at least three (3) or more homeowners. The Architectural Standards Committee is responsible for regulating the external design, appearance, safety and location of proposed repairs, alterations or additions to properties and common areas in such a manner as to (a) promote those qualities in the environment that brings value to all properties and (b) enhance the attractiveness and functional utility of the community as a place to live. To administer these responsibilities the ASC reviews proposals submitted by homeowners, compares them with established standards and submits a recommendation, for approval or rejection, to the Board of Directors who make a final determination and notify the homeowner.

SCOPE OF ASC REQUIREMENTS:

No building, fence, railing, steps, walls, signs, structure either temporary or permanent, affixed or not affixed to the ground, shall be commenced, erected, maintained, improved or altered without approval of the Board of Directors. No grading, excavation, tree removal, planting (except as provided o Sectopm 10A), change of exterior color, or other work which in any way alters the exterior appearance of any lot or improvement shall commence until a request for such work is processed through the ASC and written approval is received from the Board of Directors. The alteration request approval shall be based on the proposed modifications (a) size and location (b) exterior design (c) color and character of its exterior material (d) construction time schedule and (e) provisions for adequate and timely exterior maintenance. It is the homeowner's responsibility to select a qualified and properly insured source who can comply with the products and services specified in thse standards. The Professional Services Directory located in the mailrooms and on the Lions Gate website is a source for finding professionals recommended by Lions Gate residents.
It is recommended that any contractor used by a homeowner should be licensed in Pennsylvania and provide evidence of adequate and appropriate insurance coverage.

PROCEDURE:

The applicant must submit a fully completed Alteration Request Form to the Management Office where it is recorded and forwarded to the Architectural Standards Committee for review. If within 45 days after submittal the ASC fails to provide a written recommendation to the Board of Directors, approval will be deemed denied. The applicant may appeal an adverse decision of the Board by reapplying to the ASC.

MAINTENANCE AND CONSTRUCTION RULES AND REGULATIONS

It is the responsibility of each homeowner to maintain the condition of his/her home and dwelling area. In addition, all residents of Lions Gate Community have the responsibility to assist in the care of the common ground area. In the event, a homeowner fails to maintain his or her unit in accordance with community standards, a notice will be sent to the homeowner requesting him/her to bring their unit up to standards. In the event, the homeowner fails to do so, the Board of Directors has the authority to cause corrective action to be taken at the expense of the homeowner.
